The Press Emblem Campaign (PEC) is a non-governmental organization (NGO) with Special consultative UN status. The PEC, founded in June 2004 by a group of journalists from several countries, based in Geneva, is an international independent nonprofit and non-governmental organization. It aims at strengthening the legal protection and safety of journalists in zones of conflict and civil unrest or in dangerous missions.

FOR JOURNALISTS IN DANGER : CONTACT THE ICRC HOTLINE
The Press Emblem Campaign (PEC) recommends to contact the International Committee of the Red Cross (ICRC) hotline. Journalists on dangerous assignments can contact the closest ICRC office, or call the dedicated 24-hour hotline number +41 79 217 32 85, or send an e-mail message to press@icrc.org, in order to ask for help and advice. Basic information such as the person's name, date of birth and nationality, information about the circumstances surrounding the incident, if available, and the reasons for which assistance is being requested, should be provided. The information will subsequently be passed on to specialized ICRC staff in the field.
Can you explain what the hotline is for? Dorothea Krimitsas, ICRC's deputy head of public relations: "The primary purpose of the ICRC hotline is to enable our organization to take prompt and effective action, whenever possible, when journalists or their crew are arrested, captured, detained, reported missing, wounded or killed in areas where the ICRC is conducting humanitarian activities. There is a variety of things the ICRC may be able to do. For example, we may be able to seek confirmation of a reported arrest or capture, and obtain access to detained journalists. Or we may be able to provide information to next of kin and employers or professional associations on the whereabouts of a sought-after journalist whenever such information can be obtained. In some cases, the ICRC can help family members restore or maintain contact with a detained journalist, or it can help evacuate wounded journalists. In worst-case scenarios, it may be able to recover or transfer mortal remains".

You can also choose to be only a partner of the PEC: in this case, you support an improvement in the conditions of work of journalists and in their safety, without having to agree to the statutes of the PEC. HEDAYAT ABDEL NABI, née au Caire (Egypte) en 1948, diplômée de la Fletcher School of Law and Diplomacy-Medord Mass/USA et de la John Hopkins University, Washington DC/USA, est journaliste, co-fondatrice de la Presse Emblème Campagne (PEC) et sa présidente depuis 2004. Présidente de l'Association des correspondants auprès de l'ONU (ACANU) de 2003 à 2005, correspondante à l'ONU à Genève de la Kuwait News Agency (KUNA) de 1999 à 2010, puis pour Al Ahram. Elle a travaillé pour le quotidien égyptien Al Ahram de 1971 à 1993 avant de rejoindre le Haut Commissariat de l'ONU pour les réfugiés (HCR) de 1997 à 1999. Publications: "Dialogue with celebrities" (2004), "Dreams and Aspirations" (2009). Depuis août 2011, elle réside au Caire.
BLAISE LEMPEN, né à Berne (Suisse) en 1950, est journaliste et écrivain, co-fondateur de la Presse Emblème Campagne (PEC) et son secrétaire général depuis 2004. Diplômé du Centre universitaire d'enseignement du journalisme de Strasbourg (France) et docteur en sciences politiques de l'Université de Lausanne, il est depuis 1994 correspondant à l'ONU, à Genève, pour l'ATS (Agence Télégraphique Suisse, "Swiss News Agency"), après avoir travaillé pour les quotidiens suisses "Le Matin" (1975-1990) et "La Suisse" (1990-1994). Professeur invité à l'Université de Lausanne (1988-1998), auteur de 12 ouvrages, parmi lesquels: "La mondialisation sauvage" (Favre 1999), "La démocratie sans frontières - essai sur les mouvements antimondialisation" (L'Age d'Homme 2003), "Massacres sans témoins - Journalistes: la chasse est ouverte" (Xenia 2007), "Genève laboratoire du XXIe siècle" (éditions Georg, 2010). Statuts de la Presse Emblème Campagne (PEC) (English and Spanish text after French)
Dénomination et siège
Article 1
La Presse-Emblème Campagne (PEC) est une association sans but lucratif régie par les présents statuts et subsidiairement par les articles 60 et suivants du Code civil suisse.
Article 2
Le siège de l'association est à Genève. Sa durée est indéterminée.
But
Article 3
L'association poursuit les buts suivants:
- promouvoir auprès des gouvernements la protection des journalistes, dans les contextes de violences, dans le but de renforcer la liberté de la presse et de défendre le droit à l'information des journalistes professionnels
- promouvoir et assurer le suivi du projet de convention internationale, incuant si nécessaire un emblème de presse, qui intègrera dans ses dispositions juridiques en cas d'agression contre un journaliste dans l'exercice de sa profession: une enquête indépendante, des poursuites judiciaires contre les auteurs de l'agression et des dédommagements
- une fois que la convention sera signée par au moins un gouvernement, surveiller sa mise en oeuvre
Ressources
Article 4
Les ressources de l'association proviennent des cotisations des membres, de subventions publiques et privées. Les fonds sont utilisés conformément au but social.
Membres et organes
Article 5
Peuvent être membres de l'association: les journalistes professionnels et associations de journalistes à titre individuel ou collectif, les membres d'organisations non gouvernementales à but non lucratif à titre individuel ou collectif, les citoyens désireux de soutenir les buts de l'association.
La qualité de membre se perd par décès, par démission écrite annoncée au moins un mois avant la fin de l'exercice ou par exclusion à la majorité des deux tiers de l'Assemblée générale.
Article 6
Les organes de l'association sont:
a) L'Assemblée générale b) La Direction
Article 7
L'Assemblée générale se réunit en session chaque fois que nécessaire ou à la demande de la moitié de ses membres.
L'Assemblée générale est valablement constituée, lorsqu'au moins cinq membres sont présents.
La convocation mentionnant l'ordre du jour est adressée par la Direction à chaque membre au moins 10 jours à l'avance.
Article 8
L'Assemblée générale:
a) se prononce sur l'admission ou l'exclusion des sociétaires, en conformité avec les buts énoncés dans l'article 3
b) élit les membres de la Direction, composée du président, du (ou des) vice-président, du secrétaire général, des membres et des présidents des sections régionales de la PEC à travers le monde.
c) prend connaissance des rapports et des comptes de l'exercice et se prononce sur eux, élit un vérificateur des comptes
Article 9
Les décisions de l'Assemblée générale sont prises à la majorité simple des voix des membres présents. En cas d'égalité des voix, le président tranche.
Les décisions relatives à la modification des statuts et à la dissolution de l'association ne peuvent être prises qu'à la majorité des 2/3 des membres présents.
Les membres peuvent voter en cas d'indisponibilité en communiquant leur décision par écrit au moins deux jours avant la réunion de l'Assemblée générale.
Article 10
La Direction se compose de membres élus par l'Assemblée générale, à savoir un président, un (ou plusieurs) vice-président, un secrétaire général, les membres ainsi que les présidents des sections régionales de la PEC à travers le monde, au maximum douze membres.
La durée du mandat est de deux ans renouvelables sans limite de temps.
Article 11
La Direction est autorisée à faire tous les actes qui se rapportent au but de l'association. Elle a les pouvoirs les plus étendus pour la gestion des affaires.
Article 12
L'association est valablement engagée par la signature individuelle du président et/ou du vice-président et du secrétaire général.
Dispositions diverses
Article 13
L'exercice social commence le 1er janvier et se termine le 31 décembre de chaque année.
Les comptes sont vérifiés chaque année par le contrôleur nommé par l'Assemblée générale.
Article 14
En cas de dissolution de l'association, l'assemblée générale décide de l'attribution de l'actif social.
Article 15
Les présents statuts entrent en fonction dès leur adoption par l'AG du 2 juin 2004 tenue à Genève.
Statutes of the Press Emblem Campaign (PEC)
TITLE AND HEADQUARTERS
Article 1
The Press Emblem Campaign (PEC) is a non-profit association under article 60 and the subsequent articles of the Swiss Civil Code; it is governed by the present statutes.
Article 2
The headquarters of the association is in Geneva. Its duration is indefinite.
OBJECTIVES
Article 3
The association has the following objectives:
- to promote the protection of journalists in situations of violence, with a view to strengthening the respect for press freedom and the right of professional journalists to information
- to ensure the promotion and the follow-up of the draft international convention, including if necessary a press emblem, which will include in its legal dispositions in cases of aggression against a journalist in the exercise of his profession: an independent enquiry (investigation), legal proceedings against the authors of the aggression, and compensation
- once the convention has been signed by at least one government, to oversee its implementation.
RESOURCES
Article 4
The resources of the association come from membership fees and public and private subsidies (grants, contributions). The funds will be utilised according to the above objectives.
MEMBERS AND ORGANS
Article 5
Membership in the association is open to professional journalists and journalists' associations, as groups or in their individual capacities, members of non-profit non-governmental organisations, as groups or in their individual capacities, and all other individuals wishing to support the objectives of the association.
Membership ceases upon death, by written resignation submitted at least one month before the end of the current exercise or by exclusion pronounced by a two-thirds majority of the General Meeting.
Article 6
The organs of the association are:
a) the General Meeting b) the Board
Article 7
The General Meeting shall be held whenever necessary or at the request of one half of its members.
The General Meeting is considered as valid if at least five members are present.
The announcement of such meetings, accompanied by the agenda, shall be sent to all members by the Board at least ten (10) days in advance.
Article 8
The General Meeting:
a) approves admission or exclusion of members in conformity with the objectives stated in Article 3 b) elects the members of the Board, composed of a president, a (or more) vice-president, a secretary-general, the members and the presidents of regional sections of the PEC around the world c) takes note of and approves the reports and accounts of the current exercise and elects an auditor
Article 9
The decisions of the General Meeting are taken by a simple majority of the members present. In case of a tie, the president votes to break the tie.
Decisions concerning changes of the statutes or dissolution of the association may only be taken by a two-thirds majority of the members present.
Members may vote in writing providing they announce their inability to attend at least two days in advance of the General Meeting.
Article 10
The Board is elected by the General Meeting and is composed of a president, a (or more) vice-president, a secretary-general, the members and the presidents of regional sections of the PEC around the world up to a maximum of 12 members.
The duration of the term of office is two years, renewable without limitation.
Article 11
The Board is authorized to undertake all actions in conformity with the objectives of the association. It has broad management powers.
Article 12
The responsibility of the association is engaged by simple signature of the president and/or vice-president and/or the secretary-general.
MISCELLANEOUS PROVISIONS
Article 13
The fiscal year begins on 1 January and ends on 31 December of each year.
The accounts are inspected each year by the auditor elected by the General Meeting.
Article 14
In the case of dissolution of the association, the General Meeting decides on the distribution of its assets.
Article 15
The present statutes are valid from their adoption by the General Meeting of 2 June 2004 in Geneva.

Artículo 1
La Campaña Emblema de Prensa (PEC por sus siglas en inglés) es una asociación sin fines lucrativos regida por los presentes estatutos y subsidiariamente por los artículos 60 y siguientes del Código civil suizo.
Artículo 2
La sede de la organización radica en Ginebra. Su duración es indeterminada.
Objetivos:
Artículo 3
La asociación persigue los siguientes objetivos:
- promover ante los gobiernos la protección de los periodistas, en los contextos de violencias, con el objetivo de reforzar la libertad de prensa y de defender el derecho a la información de los periodistas profesionales.
- pomover y asegurar el seguimiento del proyecto de convención internacional, incluyendo si fuera necesario un emblema de prensa, que integrará en sus disposiciones jurídicas en caso de agresión contra un periodista en el ejercicio de profesión: una investigación independiente, demandas judiciales contra los autores de la agresión y las compensaciones
- una vez que la convención esté firmada por lo menos un gobierno, vigilar su aplicación
Artículo 4
Los recursos de la asociación provienen de la cotización de los miembros, así como de subvenciones públicas y privadas. Los fondos son utilizados conforme al objetivo social.

Pueden ser miembros de la asociación: los periodistas profesionales y asociaciones de prensa a título individual o colectivo, los miembros de organizaciones no gubernamentales con fines no lucrativos a título individual o colectivo, los ciudadanos deseosos de respaldar los objetivos de la asociación.
La condición de miembro se pierde bien por demisión escrita y anunciada por lo menos un mes antes de finalizar el ejercicio o por la exclusión por mayoría de dos tercios de la Asamblea general.
Artículo 6
Los órganos de la asociación son:
a) La Asamblea general b) La Dirección
Artículo 7
La Asamblea general debe reunirse cada vez que sea necesario o a la demanda de la mitad de sus miembros.
La Asamblea general queda legalmente constituida cuando al menos cinco miembros están presentes
La convocatoria con la orden del día es dirigida por la Dirección a cada miembro al menos con 10 días de antelación a la fecha de la Asamblea general.
Artículo 8
La Asamblea general:
a) se pronuncia sobre la admisión o la exclusión de los asociados, de conformidad con los objetivos enunciados en el artículo 3 b) elige a los miembros de la Dirección, que estará integrada por el presidente, el vicepresidente, el secretario general, los miembros y los presidentes de las secciones regionales de PEC a través del mundo. c) toma conocimiento de los informes y de las cuentas del ejercicio y se pronuncia sobre los mismos, y elige un verificador de cuentas.
Artículo 9
Las decisiones de la Asamblea general son adoptadas por mayoría simple de votos de los miembros presentes. En caso de igualdad de votos, el presidente decide.
Las decisiones relativas a la modificación de los estatutos y a la disolución de la asociación sólo podrán ser adoptadas con la mayoría de los 2/3 de los miembros presentes.
En caso de indisponibilidad, los miembros podrán votar si comunican por escrito su decisión por lo menos dos días antes de que se reúna la Asamblea General.
Artículo 10
La Dirección se compone de los miembros elegidos por la Asamblea general, a saber: un presidente, un vicepresidente, un secretario general, los miembros así como los presidentes de las secciones regionales de PEC a través del mundo, en un máximo de doce miembros.
La duración del mandato es de dos años renovables sin límite de tiempo.
Artículo 11
La Dirección está autorizada a realizar todos los actos que se correspondan con los objetivos de la asociación. Ella está dotada de los más amplios poderes para gestionar los asuntos inherentes a la organización.
Artículo 12
La asociación está legítimamente comprometida por la firma individual del presidente y/o del vicerpesidente y del secretario general.
Disposiciones diversas
Artículo 13
El ejercicio social comienza el 1ero de enero y se termina el 31 de diciembre de cada año.
Las cuentas son verificadas cada año por el verificador de cuentas nombrado por la Asamblea general.
Artículo 14
En caso de disolución de la asociación, la Asamblea general decide de la atribución del activo social.
Artículo 15
Los presentes estatutos están vigentes desde que fueron adoptados por la Asamblea general constituyente, celebrada el 2 de junio de 2004 en Ginebra.

*Why was the PEC created ?
The PEC was born in 2003 in reaction to the events which took place during the Iraq war. Murders and kidnappings of many journalists in that country were one of the triggers, as well as the growing number of journalists who are killed, aggressed and harassed and are prevented from doing their work in many parts of the world. Structural factors have also motivated its creation: the proliferation of social actors on the ground, which make their identification more complex; the generalised violation of the protection, which should be the right of civilians in all circumstances; the violation of the rules of the humanitarian law; the multiplication of new media and therefore, of the number of journalists, with problems of credibility and neutrality. Consequence of those factors, the growing difficulties for journalists to move freely, and to bear witness and investigate in different contexts. The profession is challenging obstacles hindering its access to information in many countries, obstacles which prevent it from carrying out its mission of information.
*Who is behind the Press Emblem Campaign?
It is a completely independent non-governmental and non-profit-making organization, created by a group of professional journalists. There is no hidden private or public interest behind it. Its purpose is exclusively humanitarian. It aims at defending better people working for media, all professions included, and therefore at reinforcing the public’s right to information, which is built on journalists’ freedom of movement and investigation. Although it is based in Geneva, the capital of the humanitarian law, it is not exclusively a Swiss organization: the members on its board belong to several nationalities, from northern as well as southern countries. The PEC is politically and religiously entirely neutral.
*Does the PEC duplicate with Reporters without borders, journalists associations, the International Federation of Journalists or the ICRC?
The PEC is a network of journalist's associations and a humanitarian organization, not a syndicate or an association defending a profession, as the IFJ. The PEC is not in charge of negotiating journalists’ salary conditions with employers. It is not in charge of the dialogue with the publishers or of conditions of work in the offices. Unlike Reporters without Borders and other organizations which defend freedom of expression, the PEC is a network of journalists who are fighting for a legally binding treaty specifically to protect journalists in conflict zones. It has a complementary role. It is used as a platform for coordination between the concerned organizations in order to improve the protection of journalists all around the world. The publishers and employers might also be interested in a better protection of their employees in cooperation with many insurance companies. International pressure is useful. Acts of solidarity by journalist's organisations are an effective antidote to persecution of reporters. We are strong when we act collectively. Journalists who campaign together, despite political, ethnic, regional differences, can construct a "shield of solidarity". The International Committee of the Red Cross is the guardian of international humanitarian law. But it is not mandated to defend journalists as distinct from other civilians. This is the reason why it is necessary to create an independent organization of journalists and to elaborate a Convention for the journalists.
*Wouldn't the elaboration of an international Convention with the governments open up a Pandora'box and allow some of the governments to interfere with the freedom of the press?
On the one hand, the journalists' organizations will closely control the process of negotiation and will actively take part in it. They will seek to prevent the introduction of political elements into an exclusively humanitarian Convention. If States want to introduce articles which might undermine the profession, the democratic States will have to prevent them. In the first stage, it is not necessary for the Convention to be universally accepted. Only the governments which agree with it will sign it. It is however necessary to go through the governments because they are the only ones liable for the maintenance of law and order on their territory.
*The current law is satisfactory. There is no need of a new Convention.
International humanitarian law assimilates journalists with civilians. It is therefore forbidden to kill them or to attack them, as any other civilians. To kill a journalist in a zone of conflict is already a war crime, an attack on fundamental human rights.
But journalists have a particular mission. They have to take risks to report a situation by going to dangerous places, on behalf of people’s right to information. This mission of information justifies that they benefit from special protection. The new Convention would contain reinforced obligations for the states and the warring factions, for instance the obligation to make an inquiry, to prosecute those responsible and to give compensations to the victims. It could offer new guarantees for the access to information.
Furthermore, humanitarian law is limited to armed conflicts. It does not concern other dangerous situations for journalists, i.e internal conflicts, civil unrest and violent manifestations in which journalists also need to be identified, recognised and protected. Many journalists are attacked because they write about crime and corruption. There is also a need to identify and protect them in big natural disasters.
*Will the fact of wearing a press emblem increase the targeting of journalists?
This is the argument which is the most frequently put forward against a press emblem. It is not valid for several reasons. First, journalists in zones of fighting and violence generally already wear a form of emblem, an armband or flak jacket with the word press, or they put big indications on their vehicles to distinguish themselves from the combatants. Why would they do this if they thought they would be more easily targeted? They believe, in a majority of cases, that showing their profession of journalist is a guarantee for not being mixed up with combatants and for being respected. In many contexts, it is recommended for journalists to identify themselves as media, with a valid press card.
However, those armbands and distinctive self-made signs have no legal value. They are not harmonized. They are not internationally acknowledged. A harmonized and internationally acknowledged press emblem would have the advantage of reinforcing the legal protectionof journalists. There would be less risks of confusion with other social actors on the ground.
In numerous cases, journalists have been killed, injured or attacked because their identity was not clear: they were mistaken with gunmen or military forces or wrongly perceived to be a threat or a spy. We can reduce the probability to be mistaken with a military target by avoiding looking like one: a camera can appear as a weapon if the journalists is close to a strategic target. If such an "incident" happens, it will no longer be possible to say: "We didn't know that X was a journalist" - if we are wearing a press emblem. Of course, there are also cases where journalists are intentionally targeted. We cannot avoid this - but we can fight against the impunity which is the general rule, if there are more severe legal consequences for those responsible for such acts.
*Will the emblem be compulsory?
If we think that a press identification can attract unwanted attention, we can always conceal it - even if it is not recommended to hide one's true profession. If journalists believe they will feel safer without any distinctive sign, which can happen in different contexts, there will be no obligation to wear the press emblem. In cases where they do not wear the emblem, they will continue to benefit from the legal protection currently available under humanitarian law to any civilian.
*What would be the advantages for the governments?
The governments and the warring factions might be interested in identifying better people working for media. When, in certain contexts, combatants no longer distinguish themselves from civilians, it is important, in order to avoid mistakes, to recognise journalists rapidly and at a distance. It would no longer be possible to mix up a television’s camera with a bazooka.
*Who will distribute the press emblem?
The same organizations which generally give press cards to journalists, i.e the national associations of journalists. When there are no press cards or national authority, the PEC (independant from the governments) could substitute itself for the authorities and examine individual requests. The role of the secretariat of the new international convention will be fixed in the text in order to avoid any control of the distribution of the emblems by the States. An international licensing system for the journalists by the States must absolutely be prevented.
*What will the new press emblem be like?
Professionals will have to analyze the adequate distinctive sign by taking into account the other emblems on the ground (to distinguish it, for instance, from the Red Cross and the Red Crescent, or from the UN flag). The PEC has proposed an emblem, coloured orange (neither red, nor blue), orange being a very visible colour, with the word PRESS in black letters, a word which is internationally known.
*What will be the content of the new Convention of Geneva for journalists?
The convention will be elaborated with the governments in an ad hoc group and then adopted at a diplomatic conference, as it was done for the Ottawa treaty forbidding antipersonnel mines. The PEC will participate in the drafting simultaneously with a representative group of journalist's associations and media.
QUESTIONS LES PLUS FREQUEMMENT POSEES A LA PEC
*Pourquoi la PEC a-t-elle été créée ?
La PEC est née en 2003 en réaction aux événements survenus pendant la guerre en Irak. L’assassinat et l’enlèvement de nombreux journalistes dans ce pays a été l’un des éléments déclencheurs, de même que, de manière plus générale, le nombre de plus en plus élevé de journalistes tués, agressés, harcelés, empêchés de faire leur métier dans le monde. Des facteurs structurels ont aussi motivé sa création: la prolifération des acteurs sur le terrain, qui rend les procédures d’identification plus complexes, le non-respect généralisé de la protection dont devraient bénéficier les civils en toutes circonstances et le non-respect des règles du droit humanitaire, la multiplication des nouveaux medias, et donc du nombre des journalistes, avec des problèmes de crédibilité et de neutralité, et, conséquence de ces facteurs, les difficultés croissantes des journalistes à se déplacer librement, donc à témoigner et à enquêter dans différents contextes. La profession se heurte à des problèmes d’accès à l’information dans de nombreux pays, problèmes qui l’empêchent de remplir sa mission d’information.
*Qui se trouve derrière la Presse Emblème Campagne ?
Il s’agit d’une organisation non gouvernementale, à but non lucratif, complètement indépendante, fondée par un groupe de journalistes professionnels. Il n’y a aucun intérêt caché derrière elle, de nature privée ou publique. Son but est exclusivement humanitaire. Elle veut mieux défendre les travailleurs des medias, tous métiers confondus, et donc renforcer le droit du public à l’information, qui repose sur la liberté de mouvement et d’enquête des journalistes. Bien que basée à Genève, capitale du droit humanitaire, elle n’est pas une organisation exclusivement suisse : les membres de son conseil appartiennent à plusieurs nationalités, de pays du Nord comme du Sud. La PEC est complètement neutre sur les plans politique et religieux.
*La PEC ne fait-elle pas double emploi avec Reporters sans frontières, la Fédération internationale des journalistes, les associations nationales, le CICR ?
La PEC est un réseau d'associations de journalistes et une organisation à but exclusivement humanitaire, pas un syndicat ou une association de défense professionnelle, comme les associations nationales ou la FIJ. La PEC ne s’occupe pas de négocier les conditions de salaires des journalistes avec les employeurs. Elle ne s’occupe pas du dialogue avec les éditeurs, des conditions de travail dans les rédactions. A la différence de Reporters sans frontières et d’autres organisations défendant la liberté d’expression, la PEC est un réseau de journalistes dont le but spécifique est d'élaborer un traité juridiquement contraignant pour protéger les journalistes dans les zones de conflit. Elle a un rôle complémentaire. Elle sert de plate-forme de coordination entre les organisations concernées. Les éditeurs et employeurs devraient également être intéressés à une meilleure protection de leurs employés en coopération avec les compagnies d’assurances. Les pressions internationales sont utiles. Les actes de solidarité des organisations de journalistes sont souvent efficaces. Nous sommes forts lorsque nous agissons ensemble. Les journalistes qui, en dépit de différences politiques, ethniques, régionales, travaillent ensemble peuvent créer un "bouclier de la solidarité". Le Comité international de la Croix-Rouge est le gardien du droit humanitaire international. Mais il n’a pas de mandat pour défendre les journalistes plutôt que d’autres civils. Raison pour laquelle il est nécessaire de créer une organisation indépendante de journalistes, et d’élaborer une Convention de Genève pour les journalistes.
*Elaborer avec les gouvernements une Convention internationale, n'est-ce pas ouvrir la boîte de Pandore et permettre à certains d'entre eux de s'ingérer dans les affaires des journalistes ?
D’une part, les organisations de journalistes contrôleront étroitement le processus de négociation et y participeront activement. Ils éviteront le détournement pour des motifs politiques d’une Convention exclusivement à but humanitaire. Si des Etats veulent introduire des clauses nuisibles à la profession, il faudra faire en sorte que les Etats démocratiques les en empêchent. Il n’est pas nécessaire que la Convention soit universellement acceptée dans un premier temps. Elle pourra être signée par les gouvernements qui l’acceptent. Mais il est indispensable de passer par les gouvernements, parce qu’ils sont juridiquement seuls responsables de la loi et de l’ordre sur leur territoire.
*Le fait de porter un emblème de presse transformera-t-il les journalistes en cibles ?
C’est l’argument le plus souvent avancé contre un emblème de presse. Il ne tient pas la route pour plusieurs raisons : d’abord, les journalistes dans des zones de conflit ou de violences portent en général déjà une forme d’emblème, un brassard avec le mot presse, ou confectionnent de grands écriteaux sur leurs véhicules pour se distinguer des combattants. Pourquoi le font-ils, s’ils pensaient être ainsi plus facilement visés ? Ils estiment que, dans la plupart des situations, le fait de montrer sa profession de journaliste est une garantie de ne pas être confondus avec des combattants et d’être respectés. Dans de nombreux contextes, il est recommandé aux journalistes de s'identifier comme media, avec une carte de presse valable.
Ces brassards et signes distinctifs artisanaux n’ont cependant pas de valeur juridique. Ils ne sont pas uniformes. Ils ne sont pas reconnus internationalement. Un emblème de presse uniforme et reconnu internationalement aurait pour avantage de renforcer la sécurité juridique des journalistes. Il y aurait moins de risques de confusion avec d’autres acteurs sur le terrain.
*L’emblème sera-t-il obligatoire ?
Si nous estimons qu'une identification comme media peut provoquer une agression, nous pouvons la dissimuler. Il n’y aura aucune obligation de porter l’emblème de presse, si le journaliste estime qu’il se sent plus sûr sans signe distinctif, ce qui peut être le cas dans différents contextes. Dans le cas où il ne porte pas l’emblème, il bénéficiera de la protection juridique actuelle, c’est-à-dire celle due par le droit humanitaire à tous les civils.
*Quel avantage en retireront les gouvernements ?
Les gouvernements et les forces belligérantes peuvent être intéressés à mieux identifier les travailleurs des medias. Alors que dans certains contextes, les combattants ne se distinguent plus des civils, il est important de reconnaître rapidement et de loin les journalistes pour éviter les méprises. Ainsi il ne devrait plus être possible de confondre une caméra de télévision avec un bazooka.
*Qui distribuera l’emblème de presse ?
Les mêmes organisations qui donnent en général la carte de presse aux journalistes, à savoir les associations nationales de journalistes. Lorsqu’il n’y a pas de carte de presse ou pas d’autorité nationale, la PEC (indépendante des gouvernements) pourrait se substituer à cette autorité défaillante en examinant les dossiers individuellement. Le rôle du secrétariat de la future convention internationale sera fixé dans le texte de manière à éviter toute possibilité de contrôle de distribution des emblèmes par les Etats. Il n'est pas question de créer un système d'autorisation international qui donnerait aux gouvernements un droit de regard sur le fait de savoir qui est journaliste.
*Comment se présentera le nouvel emblème de presse ?
Des professionnels devront déterminer le signe distinctif adéquat, en tenant compte des autres emblèmes sur le terrain (pour le distinguer par exemple de la Croix-Rouge et du Croissant-Rouge, ou du drapeau de l’ONU). La PEC a présenté une proposition d’emblème, de couleur orange (ni rouge, ni bleu), l’orange étant une couleur très visible, avec le mot en lettres noires PRESS, un mot qui est internationalement connu.
*Quel sera le contenu de la nouvelle Convention de Genève pour les journalistes ?
La Convention sera élaborée avec les gouvernements dans un groupe de travail ad hoc puis adoptée lors d’une conférence diplomatique, comme ce fut le cas pour le traité d’Ottawa interdisant les mines antipersonnel. La PEC participera à ces travaux en même temps qu’un groupe représentatif d’associations de journalistes et de medias.
